Software License and Limited WarrantyThis legal document is an agreement between you, THE LICENSEE,and Resco, Ltd. THE LICENSOR. By executing the programfiles, you agree to be bound by the terms of this agreement,which includes the Software License, Limited Warranty andAcknowledgment. If you do not agree to the terms presented in thisagreement, DO NOT OPEN the program files. In order to protect ourrights, Resco, Ltd. does not SELL any rights to software.Rather Resco, Ltd. grants the Right to Use the software bymeans of a SOFTWARE LICENSE. Resco, Ltd. specificallyretains the title to all Resco, Ltd. computer software.SOFTWARE LICENSE1. Grant of a License. In consideration of payment of The LICENSE FEE(part of the price you paid for this product), and your agreementto abide by the terms and conditions of this License and the LimitedWarranty, Resco, Ltd., THE LICENSOR, grants you,THE LICENSEE,a non-exclusive right to use this copy of the Resco, Ltd.software program named "Resco Photo Viewer" on the numberof computers specified in the heading of this License so long as youcomply with the terms of this License.2. Ownership of Software. As a Licensee, you own the physicalmedia on which the software is originally or subsequently recorded,but an express condition of this License is that Resco, Ltd.retains title and ownership of the Software recorded on theoriginal disk(s) and all subsequent copies of the Software,regardless of the form or media in or on which the original and othercopies may exist. This License is NOT a sale of the originalSoftware or any copy.3. Copying Restrictions. This software and the accompanying writtenmaterials are the subject of copyright. Unauthorized copying of thesoftware, including Software that has been modified, or of the writtenmaterials is expressly forbidden. You may be held legally responsiblefor any copyright infringement which has been encouraged or causedby the failure to abide by the terms of this License.4. Use Restrictions. Separation of Components. The SOFTWARE is licensed asa single product. Its component parts may not be separated for use onmore than one computer.Rental or Lease. You may not rent or lease the SOFTWARE.Software Transfer. You may permanently transfer all your rightsunder this License, provided you retain no copies; you transferall of the SOFTWARE, including all component parts, the media, anyupgrades and this License; and the recipient agrees to the termsof this License.6. Termination. Without prejudice to any other rights, Resco, Ltd.may terminate this License if you fail to comply withthe terms and conditions of this License. In such event, you mustdestroy all copies of the SOFTWARE and all of its component parts.7. Miscellaneous. This License shall be governed and construedinaccordance with the International laws and shall benefitResco, Ltd., its successors and assigns.LIMITED WARRANTY AND DISCLAIMER OF WARRANTYThe software and accompanying written material (includinginstructions for use) are provided "as is" without warranty of anykind. Further, Resco, Ltd. does not warrant, guarantee or makeany representations regarding the use or the results of use, ofthe Software or written materials in terms of correctness, reliability,accuracy or fitness for purpose. The entire risk as to the resultsand performance of the software is assumed by you. Should thesoftware be defective, you and not Resco, Ltd. or its dealers,agents, distributors or employees, assume the entire cost of allnecessary repair, servicing and correction.The above is the only warranty of any kind, either express orimplied, including but not limited to the warranties ofmerchantability and fitness for purpose, that Resco, Ltd. makesregarding this product.
